Please read the following Terms and Conditions.

It is a condition of your access to www.mumsgetaway.com.au (“this website”) that you accept and comply with all the terms, conditions, notices and disclaimers set out on it. By purchasing any product or service through Mum’s Getaway Pty Ltd ABN 12 858 215 0810 (hereinafter “Mum’s Getaway”), you agree to the following Terms and Conditions:

  1. All advertised prices are displayed in Australian dollars and are inclusive of GST. Prices are quoted per person and are based on twin/double occupancy, unless otherwise stated. An additional single supplement charge will apply if you are a solo traveller.
  2. All getaway packages are subject to availability at the chosen destination. We cannot and do not guarantee such availability. If, after reasonable attempts to book your getaway in accordance with these Terms & Conditions you cannot find availability, at the sole discretion of Mum’s Getaway the amount you have paid, less the value of the Gift Box, will be refunded to you. Please ensure you check the Exclusion Dates (listed in the Other Details section at the end of each Package description) before purchase and booking to avoid disappointment.
  3. If you must cancel or postpone the date of your Mum’s Getaway package after it has been booked, the Cancellation Policy for the particular accommodation property will apply. This policy is stated on your Booking Confirmation Certificate and you should familiarise yourself with that Cancellation Policy as it forms part of these Terms and Conditions. As long as the accommodation property refunds money paid to them on your behalf by Mum's Getaway Pty. Ltd., all money paid by you to Mum's Getaway will be refunded to you less an administration fee of $25.00 per person for cancellation. There will be no administration fee for a single incidence of date change. If the Gift Box has already been delivered to you, the retail value of this will also be deducted from the money to be refunded to you in the event you cancel altogether.
  4. The material provided on this website is for general information purposes only and does not constitute advice. It is based on information supplied to us by third parties. While we make reasonable efforts to ensure this website is accurate, we do not warrant the accuracy, completeness, fairness, suitability or reliability of any information, accommodation, service or product listed at mumsgetaway.com.au.
  5. Mum’s Getaway takes no responsibility for or in connection with the accommodation, its suitability, quality, services and other facilities of the accommodation property chosen by you via this website.
  6. Any transaction made by you is deemed to be made directly with the respective vendors of the products and services provided on this website and selected by you. Where a Mum’s Getaway package (service or product) is purchased as a gift for and used by a third party, then it shall be the responsibility of the purchaser to ensure that third party is aware of the Terms and Conditions of purchase.
  7. You agree that Mum’s Getaway may disclose relevant information to your chosen accommodation property for the purpose of booking your package with them and with the selected courier service used by Mum’s Getaway for the purpose of delivering your Gift Box.
  8. You acknowledge and agree that this website contains links to other websites maintained by third parties and Mum’s Getaway is not responsible for and does not operate or control any information or services provided on such third party sites.
  9. Mum’s Getaway reserves the right to vary the conditions contained on this website from time to time. Visitors to this website must accept the Terms and Conditions each time they visit this website. Continued use of this website shall constitute acceptances of the Terms and Conditions as varied from time to time.
  10. These Terms and Conditions do not vary or affect consumer’s statutory rights. If any part of these Terms and Conditions is held by a court to be contrary to law then those provisions will be excluded and all other provisions remain in full force and effect.
  11. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the state of New South Wales, Australia. You and Mum’s Getaway agree to submit to the exclusive jurisdiction of the courts of the State of New South Wales, Australia and any court of appeal from them.
  12. If Mum’s Getaway fails to exercise or enforce any rights or provisions of these Terms and Conditions, it will not constitute a waiver of that provision unless Mum’s Getaway agrees in writing.

    Liability

Mum’s Getaway disclaims all liability for any loss or damage, direct or indirect, which may be suffered through relying on any information omitted from or contained on this website or any promotional material for it, or as a result of any products or services purchased through Mum’s Getaway, or any delay or inability to use this website, whether based on tort, contract, strict liability or otherwise.
  14. In respect of any claim, Mum’s Getaway’s liability shall not exceed the price of the product or service purchased through Mum’s Getaway or shall be satisfied by the process of replacement services.
  15. You agree to indemnify Mum’s Getaway and its related bodies corporate, directors, employees, agents and representatives against any and all loss of any kind (including legal fees) that may be incurred by them arising out of or in connection with your use of this website and any related purchase of products and services.
